Queensland rental properties must meet minimum housing standards at the start of a tenancy and throughout the tenancy. For security, that includes specific requirements for external doors and windows.
Functioning locks or latches are required
The RTA states that rental properties must have functioning locks or latches on all external doors and windows that can be reached from outside without a ladder.
This is a minimum standard. It does not mean every property requires the same type of lock, deadbolt or security screen. The RTA says each property should be assessed case by case to ensure it is secure and that reasonable measures have been taken to meet the safety and security requirements.
What does “reasonably secure” mean?
The Residential Tenancies and Rooming Accommodation Act requires the lessor to supply and maintain the locks necessary to ensure the premises are reasonably secure. The legislation does not prescribe one universal lock specification for every Queensland rental property.
In a dispute about locks and security, factors can include the property itself, surrounding circumstances, risk of unlawful entry and other relevant considerations. The practical question is not simply whether a lock exists, but whether the security arrangements are reasonable for that property.
A working lock can still need attention
A lock may technically operate but still deserve attention if the door or frame is badly misaligned, the latch does not engage reliably, the hardware is damaged, or known keys are missing. Security should be assessed as a complete system: door, frame, lock, strike, key control and normal use.
External windows and doors
Accessible external doors and windows should be checked at the start of a tenancy and maintained throughout it. A broken latch, failed lock or door that cannot be secured should be reported promptly. Where the problem leaves the property insecure, the RTA notes it may require an emergency repair.
Security screens do not replace the basic requirement
The RTA states that additional security measures such as security screens or grilles do not remove the requirement for the rental property to meet minimum housing standards for functioning locks or latches.
